- Working Hours Act (ArbZG), § 16 Posting and timesheets
- The recording obligation for employers in Germany has yet to be legally revised in accordance with the ECJ ruling of May 14, 2019. However, the obligation to keep records is already mandatory by law for certain areas
- In its decision of 13 September 2022 (Ref. 1 ABR 22/21), the Federal Labour Court (Bundesarbeitsgericht, BAG) ruled that in Germany the entire working time of employees must be recorded. Employers are obliged under section 3(2)(1) of the Occupational Health and Safety Act (Arbeitsschutzgesetz - ArbSchG) - interpreted in conformity with the Union - to introduce a system to record the working time worked by employees. The BAG has thus bindingly decided that the ruling of the European Court of Justice (ECJ) of 14 May 2019 (ECJ Case 55/18 CCOO) must also be observed by German employers. What this means in practice is that an employer can hardly defend itself against, possibly, false overtime claims by its employees if it does not record the working time of its employees in its business.
- Conclusion for employers in Germany: In order to avoid litigation risks due to a lack of evidence, employers should even now record their employees' working hours. Violations of the applicable recording obligation can be subject to a fine of up to € 30,000, as the employer's obligation to record working hours already applies to certain areas due to the statutory minimum wage.
- The Federal Ministry of Labour and Social Affairs (BMAS) published "Questions and Answers on Time Recording" on 3 May 2023.
